Ceci, en lien avec l\u2019affaire de la non d\u00e9sactivation des cartes SIM non enregistr\u00e9es qui avait valu \u00e0 l\u2019op\u00e9rateur une amende de 1,1 milliards de dollars. Dans une communication qui date du 2 ao\u00fbt 2019, <a rel=\"noreferrer noopener\" aria-label=\"MTN Nig&#xE9;ria (s&#x2019;ouvre dans un nouvel onglet)\" href=\"https:\/\/www.digitalbusiness.africa\/amende-de-330-milliards-de-nairas-mtn-nigeria-regle-ses-comptes\/\" target=\"_blank\">MTN Nig\u00e9ria<\/a> a fait savoir qu\u2019il a demand\u00e9 un contr\u00f4le judiciaire apr\u00e8s que l&#8217;administration fiscale nig\u00e9riane a d\u00e9sapprouv\u00e9 le traitement comptable par l&#8217;entreprise de l&#8217;amende en tant que co\u00fbt d&#8217;exploitation. <em>\u00ab\u00a0Nous pensons que l&#8217;amende devrait \u00eatre trait\u00e9e comme une partie des co\u00fbts d&#8217;exploitation de l&#8217;entreprise, mais l&#8217;autorit\u00e9 fiscale nig\u00e9riane, la Federal Inland Revenue Service (<a rel=\"noreferrer noopener\" aria-label=\"FIRS (s&#x2019;ouvre dans un nouvel onglet)\" href=\"https:\/\/www.digitalbusiness.africa\/first-bank-of-nigeria-en-partenariat-avec-clickatell-lance-avec-un-service-de-chat-banking-sur-whatsapp\/\" target=\"_blank\">FIRS<\/a>) pense le contraire. Nous avons tout pay\u00e9 \u00e0 la FIRS, puis nous sommes all\u00e9s devant le tribunal<\/em>\u00a0\u00bb, explique le porte-parole de MTN dans un communiqu\u00e9.<\/p>\n\n<p class=\"wp-block-paragraph\">De mani\u00e8re concr\u00e8te, MTN demande \u00e0 la <a href=\"https:\/\/www.digitalbusiness.africa\/democratie-numerique-les-quatre-demandes-du-sommet-mondial-du-partenariat-pour-un-gouvernement-ouvert\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"justice fiscale (s&#x2019;ouvre dans un nouvel onglet)\">justice fiscale<\/a> nig\u00e9riane de d\u00e9cider si elle doit payer au gouvernement une taxe sur les soci\u00e9t\u00e9s pour une amende de 1,1 milliard de dollars. Ou si \u00e0 la place, elle est autoris\u00e9e \u00e0 traiter cette amende comme \u00e9tant un co\u00fbt d&#8217;exploitation. S\u2019il arrivait que la Justice nig\u00e9riane donne raison \u00e0 MTN, cela cr\u00e9erait un pr\u00e9c\u00e9dent en ce qui concerne la mani\u00e8re dont les sanctions sont trait\u00e9es par les soci\u00e9t\u00e9s enregistr\u00e9es au Nig\u00e9ria.<\/p>\n\n<p class=\"wp-block-paragraph\">This new case adds to the long list of conflicts between MTN Nigeria and the Nigerian authorities. Already in October 2015, the operator was fined $5.2 billion for failing to deactivate unidentified telephone lines in a timely manner. Finally, the fine was reduced to $1.1 billion after multiple negotiations, including at the top of the state.<\/p>\n\n<p class=\"wp-block-paragraph\">Then, in August 2018, MTN Nigeria was summoned by the Central Bank of Nigeria to repatriate $8.13 billion to Nigeria. Funds considered to have been illegally taken out of the country, with the complicity of local banks. To get out of this other case, MTN had to pay a fine of $51.7 million. Even today, MTN is still accused by the Nigerian authorities of non-payment of taxes on the import of equipment and on its payments to foreign suppliers.
